Terms of Agreement*

I hereby affirm my agreement to include an additional $20 per week in addition to my existing membership fee, as stipulated in the original contract between myself and Shredded Health & Performance.

Kindly be aware that this amendment form solely pertains to adjustments in your membership rate, without altering any of the initial terms and conditions stated in your original contract.

This contract variation is between Shredded and the afore-signed member. This form relates to the terms and conditions of the additional cost per week of $20 to apply unlimited access of Ice bath and Infrared Sauna sessions at Shredded which are subject to available booking times. To ensure you obtain your prefered booking tims please ensure you pre book your session times. This can be done at Reception or through the Mindbody App.

Dress / Towel policy: Shredded Health & Performance requires you to wear appropriate clothing and footwear while in the facilities. You must have a cloth towel with you during sessions to protect and clean the machines you use. During your booked Infrared Sauna and Ice Bath Sessions a towel will be provided to you for personal use. Please ensure you return the towel to reception or place it in the allocated towel hamper within the room.

Suspensions: Members may suspend their membership at a cost of $10 per fortnight. To request a suspension, please see our reception team or email customercare@shredded.com.au. Each member is allowed a maximum suspension period of 2 weeks for every 12 weeks of membership. Requests for extended suspensions will be considered individually and may require supporting evidence. Please ensure suspension applications are submitted 5 days prior to the desired start date of suspension, to guarantee correct adjustment and timely processing of membership auto payments.

Cancellation Policy: All memberships will continue in effect beyond the minimum agreed term until explicitly cancelled by the membership holder. A notice period of 4 weeks is required to cancel any membership, which must be directly communicated to Shredded Health & Performance by the membership holder. If the membership is cancelled within the agreement term, a cancellation fee applies. This fee will amount to 25% of the remaining cost of the agreement term.

Downgrading/ Variations to your Membership: Should you wish to downgrade or remove an add-on to your membership, you have two options: visit the reception desk or email customercare@shredded.com.au. You will receive a link to a user-friendly online form to confirm your requested change. Please be aware that the change will only be implemented once the completed form has been submitted.

Ice Bath Use - Terms and Conditions:*

I have carefully read and fully understand all provisions of this release. I willingly and knowingly accept the associated risks and waive any liability as explained below.

Ice Bath Terms and Conditions:
- I warrant, and agree that, as the Participant:
- I will not use the facilities under the influence of alcohol or drugs (including any prescription drugs causing drowsiness or unconsciousness);
- I do not have any communicable or infectious skin condition, disorder or diseases, large cuts, open sores or wounds;
- I will shower thoroughly before entering the ice bath, ensuring all oils, creams, or makeup is removed from my body.

- I do not have a kidney disease;
- I do not suffer from epilepsy or chronic heart disease or, if I do, my use of the ice bath has been approved by a medical physician in writing;|
- I am not pregnant and I do not suffer from diabetes or low blood pressure, or my use of ice baths has been approved by a medical physician;
- I do not have a condition, and I am not medicated in any manner, which may be adversely affected by cold water immersion
- I will not use the ice bath if I have incontinence, and will not voluntarily/involuntarily release bodily fluids of any kind while inside the ice bath;

- I am not currently menstruating;
- I currently do not have hair extensions;
- I understand that shaving or waxing 24hrs before entering the ice bath can sting or irritate my skin
- I am not currently cytotoxic and will not use the ice bath whilst undergoing any cytotoxic treatment (e.g. Chemotherapy). I will check with my medical physician to see how long I must wait until I am no longer cytotoxic.
- I will use great caution while entering and exiting the ice bath and the entire time I am in the facility. I understand there is a risk of wet and slippery surfaces; and
- I understand that the ice bath is not discarded/drained between each session, but is filtered, sanitised and recycled, and that our ice baths are inspected between every single session.

I have not:
- had any chemical processing or permanent dye of my hair within the past 2 weeks;
- had my hair subject to Keratin treatment in the last 4 weeks;
- used any Henna products in the last 4 weeks;
- used spray, lotion or any other fake tanning products in the past 7 days;
- had any semi-permanent dyes used in my hair (must wait until fully washed out).

I understand that if I breach these Ice Bath Terms, or otherwise contaminate the water of the ice bath, I will be financially responsible for draining and replacing the water and special cleaning services (up to $1,000).

Cancelation Policy:
- We require at least 24 hrs notice so we can make the booking available for other customers.
- Less than 24hrs notice will incur a charge of the full value of your booking.
- I acknowledge and understand that failing to provide any notice (No Show) for my pre-booked appointment will result in a charge for the full value of my booking, amounting to $30 per no show. This charge will be applied to my agreed payment method on file.

Liability Waiver:
- I have requested that I participate in the ice bath services and related activities with Shredded Health & Performance Pty Ltd.
- I acknowledge and agree that these activities include being submerged in water, within a semi enclosed space.

In consideration for your agreement to the terms and conditions of this Liability Waiver and Ice Bath Terms, Shredded Health & Performance Pty Ltd agrees to allow you to participate in the Activities.

- I acknowledge and agree that I participate in the Activities at my risk.
- I release Shredded Health & Performance Pty Ltd and its officers, employees and contractors, the organisers, sponsors, other participants and any other persons involved in my participation in the Activities (Releasees) from any demand, claim, or other proceeding in relation to any injury or death or loss or damage to personal property in connection with my participation in the Activities, whether or not caused by the negligence of a Releasee.
- I agree to indemnify each Release in relation to any demand, claim or proceeding that may be brought in connection with my participation in the Activities with Shredded Health & Performance Pty Ltd, including any breach of the Ice Bath Terms.
- I agree and represent that I have no injuries, physical or mental restrictions, disabilities or predispositions to sickness or injury that may affect my participation in the Activities.
- I agree and represent that I am not under the influence of alcohol or any drug that may in any way affect my participation in the Activities, my safety or the safety of others.

Infrared Sauna Use - Terms and Conditions:*

Infrared Sauna Use Waiver and Release of Liability
The use of infrared saunas may have many health benefits; however, it is important that you fully understand how to use the sauna and gradually introduce your body to the infrared sauna therapy to produce the best results. In all situations, hydration is a requirement for sauna use. Drinking filtered water or even advanced electrolyte replacement water is recommended before and after sauna use.
Consent to use the far infrared Sauna is conditional upon provision of the following information and signing the Infrared Sauna Agreement. Self-treatment of any disease with an infrared sauna is not recommended without direct supervision of a certified healthcare provider. If anything listed below applies to you, please consult your health professional before using the infrared sauna.

Individuals who are using prescription drugs should seek the advice of their personal physician or a pharmacist for possible changes in the drug’s effect when the body is exposed to infrared waves or elevated temperatures. Some medications including diuretics, barbiturates, and beta-blockers and others may impair the body’s natural heat loss mechanisms. Some over the counter drugs such as antihistamines may also cause the body to be more prone to heat stroke.
Pregnant women should consult a physician before using the sauna because foetal damage can occur with a certain elevated body temperature.
Individuals with cardiovascular conditions or problems (hypertension/hypotension), congestive heart failure, impaired coronary circulation or those who are taking medications which might affect blood pressure should exercise extreme caution when exposed to prolonged heat. Heat stress increases cardiac output and blood flow in an effort to transfer internal body heat to the outside environment via the skin (perspiration) and respiratory systems. If using a pacemaker or defibrillator, please discuss risks involved with your physician.
If you have a recent joint injury, it should not be heated for the first 48 hours after injury or until the hot and swollen symptoms subside.

Surgery & Scars; If you are recovering from surgery and have a scar in the healing phase you must receive permission from your surgeon before using the sauna.

I acknowledge and accept the risks inherent in the use of the infrared Sauna at Shredded Health & Performance PTY LTD. I voluntarily assume the risk of injury, accident or death, which may arise from the use of the Infrared Sauna. I and any of my heirs, executor, representatives or assigns hereby release from all claims or liabilities for personal injury or property damages of any kind sustained while on the premises, during the use of the Infrared Sauna and from any advice provided by an employee, independent contractor or any representative of I agree that this Application and waiver is in effect for all Infrared Sauna sessions and will not expire unless requested by either party.
